Description
In the common law syllabus, the key division in the property subjects is between Land Law and the Law of Equity and Trusts. The course looks at both aspects, developing knowledge of foundational principles, laying the ground for later study as the programme progresses.
The study of (English) Land Law can be first accessed through attention to the key concepts of freehold/leasehold estates, the creation and transfer thereof, and ownership of property.
Taking a more sociological approach, Land can also be understood through attention to questions of "security" and "precarity" as well as "license". Ultimately, the course will move on to look at types of interest in Land Law, such as the convenant and easement.
The nature and character of Equity and Trusts is also a fundamental building block of property law. Trusts intersect with Land Law. And so, the course culminates in a specific focus on trusts of family home, and then charitable trusts.
